Scholars and commentators increasingly worry that the United States is facing a constitutional crisis, but the exact meaning of this crisis remains unclear. In this talk, Aziz Rana will explore how the present moment in the US is best understood as embodying the collapse of a midcentury constitutional compact that was consolidated over the course of three critical decades, from the 1930s to the 1960s. This consolidation took place against the backdrop of Cold War dynamics and global decolonization. Thus, the American constitutional project was forged through and gained meaning from its antagonism with the Soviet Union. Today, the Soviet Union is long gone and the country has witnessed a steady defection from the terms of that past compact. The result has been institutional and democratic breakdown, without a clear pathway for renewal. All of this suggests that reform in the US will likely require more than simply restoration of a past settlement, but a far more extensive undertaking in political transformation.
The talk will be followed by a conversation between Aziz Rana and Leila Brännström, in which they will explore the implications of the US constitutional crisis beyond the US itself, and the extent to which we in this part of the world are also experiencing the unraveling of the midcentury constitutional compact.
Aziz Rana is a professor of law at Boston College Law School. His research and teaching center on American constitutional law and political development. In particular, his work focuses on how shifting notions of race, citizenship, and empire have shaped legal and political identity since the founding. He is the author of two books, The Constitutional Bind: How Americans Came to Idolize a Document That Fails Them and The Two Faces of American Freedom.
Leila Brännström is a professor of general jurisprudence at the University of Gothenburg. Her research and teaching interests are focused on political and legal theory. Between 2002 and 2012 she was in different capacities involved in the production of Fronesis.

USA går igenom en konstitutionell kris men det finns ingen klarhet om vad den beror på eller för med sig. I detta föredrag gör den amerikanska professorn i konstitutionell rätt Aziz Rana gällande att krisen har uppstått till följd av att den konstitutionella uppgörelse som tog form i USA kring 1900-talets mitt och som länge ramade in de konstitutionella praktikerna nu brutit samman. Uppgörelsen hade konsoliderats mot bakgrund av det kalla krigets dynamik och avkoloniseringsvågen som svepte över världen vid den tiden. I det här läget spelade motsättningen mot och rivaliteten med Sovjetunionen en avgörande roll för uppgörelsens inriktning och innehåll. I dag är Sovjetunionen borta sedan länge och USA har fjärmat sig allt längre från den konstitutionella uppgörelse som tidigare gällde, men utan att någon ny riktning har utstakats. Eftersom vår tids förutsättningar är andra, menar Rana, kan den konstitutionella reformpolitiken i USA inte inriktas på att återuppliva den tidigare uppgörelsen utan måste sikta mot en betydligt mer långtgående politisk förändring.
Föredraget kommer att följas av ett samtal mellan Aziz Rana och Leila Brännström om den amerikanska konstitutionella krisens implikationer utanför landets gränser, och om huruvida man kan tala om ett motsvarande sammanbrott även i vår del av världen.
Aziz Rana är professor i juridik vid Boston College Law School. Hans forskning och undervisning är inriktad på amerikansk konstitutionell rätt och politisk utveckling.
